Malema to attend pre-sentencing hearing over firearm allegation

EFF President and Commander-in-Chief Julius Malema will attend a pre-sentencing hearing in court.


The hearing relates to allegations that he discharged a firearm during the EFF’s 5th Anniversary Celebration.
The case follows Malema’s conviction on charges linked to the incident. The event took place at a large political rally attended by thousands of supporters.


During the celebration, Malema seen firing a rifle into the air. Authorities later confirmed that the firearm was real.
The state argues that the action was unlawful. Prosecutors say it placed members of the public at risk. They insist that political leaders must obey the law.


The state also says Malema’s position should not shield him from accountability. Prosecutors believe the offence is serious.


Malema and the EFF reject the state’s claims. The party says the case is politically motivated. EFF leaders argue that the charges target their organisation.
Malema’s legal team admits that he fired the rifle. However, they say the act was ceremonial. They insist that no one was injured.


The defence also claims selective prosecution. They argue that similar actions by other leaders did not result in charges.
The pre-sentencing hearing will allow both sides to address the court. The state will argue for an appropriate sentence. The defence will present mitigating factors.


The court will consider Malema’s personal circumstances. It will also consider his role as a public figure.
EFF supporters are expected outside the court. The party has urged members to remain peaceful. Police are expected to maintain order.


The court may reserve judgment after the hearing. A sentencing date could be announced later.
